Terms and conditions
If you do not agree to these terms and conditions, please do not use the website, or purchase any of our products or services that we provide.
We strongly recommend that you seek professional medical advice before embarking on any exercise programme and are fully aware that exercise of any kind brings with it an inherent risk of injury.
All information is for general purposes only.
1. Introduction
a) These terms explain how you may use this website (www.tourstrength.co.uk).
b) These terms will apply to all users (‘you’) of the website and all purchasers of products including the Tour Strength app.
c) You should read these terms carefully before using the site or purchasing any of our products or services from the site.
d) By continuing to use the site and/or purchasing products, such as a subscription to the Tour Strength app, you agree to be bound by these terms of use.
e) If you do not agree with these terms of use you should stop using the site immediately and not purchase any of the products or services we provide through this site.
f) We reserve the right to make amendments to these terms from time to time. Our updated terms will be displayed on the site and by continuing to use and access the site following such changes, you agree to be bound by any alteration made by us. It is your responsibility to check these terms from time to time to verify such changes.

2. The Tour Strength App
a) Subscription for this product is available to purchase from the site. The fees payable to purchase the different app subscriptions (yearly or monthly) are clearly displayed on the website.
b) Upon registration for the app you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. If you know or suspect that someone else knows your password you should notify us by contacting us immediately by email at ben@tourstrength.co.uk
c) If we have reason to believe that there is likely to be a breach of security or misuse of the app through your account by means of the use of your password or otherwise, we may require you to change your password or we may suspend your account. Until we are satisfied that your account is secure, you may not be able to access the app.
d) All payments for app subscription will be done utilising the Passion pay system in conjunction with Stripe. You will be asked to read and agree to their terms and conditions before downloading the app.
e) You agree that by purchasing the app and participating in the exercises, you are doing so at your own risk and acknowledge that that there is the possibility of physical injury. See section 9 (limitation on our liability) for more information.
3. Accountability Coaching
a) accountability coaching is an online coaching service which includes the following services: a bespoke nutrition plan, nutritional analysis videos on request, weekly online check in form, revisions and customisations to the training programs, weekly feedback based on your check in forms and Whatsapp access to your coach.
b) Due to this service being of limited availability, we hold the right to terminate the subscription agreement held between us should we deem that the relationship is not mutually beneficial. We will still fulfil the remaining term on the contract you have signed up for, but upon renewal date, our contract will be terminated.
c) The £65 fee is a recurring monthly payment taken on the same day each month as the date you initially subscribed.
d) You agree that by purchasing the app and participating in the exercises, you are doing so at your own risk and acknowledge that that there is the possibility of physical injury. See section 9 (limitation on our liability) for more information.

4. Bespoke Nutrition Plan
a) The Bespoke Nutrition Plan is a one off fee product in which you will receive a nutrition plan based on your personal information and goals.
b) You will receive, a nutrition plan with your own bespoke calorie and macro nutrient targets, information on how to adjust your nutrition over time, along with one nutritional analysis video where we provide a report based on your MyFitnessPal food diary.
c) Tour Strength cannot guarantee the results obtained from this Bespoke Nutrition Plan.
5. Cancellation policy
a) As the Tour Strength app is a download, as soon as it has been downloaded, whatever subscription you have signed up for (yearly or monthly) it cannot be cancelled and no refund can be given.
b) If on the years subscription, once it finishes, it will automatically renew. This can be cancelled at any time through logging in to your account on this website or by emailing ben@tourstrength.co.uk. You will still receive access to the app and all of it’s content until your subscription is due for renewal.
c) If on the monthly subscription, this automatically renews unless cancelled. The subscription can be cancelled at any time through logging in to your account on this website or by emailing ben@tourstrength.co.uk. You will still receive access to the app and all of it’s content until your subscription is due for renewal.
d) With Accountability coaching, upon cancellation of your subscription, you will still be eligible for and receive Coaching up until 1 day prior to your next payment instalment was due.
e) With Accountability Coaching, no refunds will be issued should you decide to cancel your Accountability Coaching subscription.
f) To cancel your Accountability Coaching subscription, you will need to sign in to your account and manually cancel your subscription through the website.
6. Your privacy and personal information
a) Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our privacy policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us in the event you have a query or complaint about the use of your personal information.

7. Accuracy of information and availability of the site
a) Whilst we try to make sure that the site is accurate, up-to-date and free from bugs, we cannot guarantee that it will be. Furthermore, we cannot promise that the site will be fit or suitable for any purpose. Any reliance that you may place on the information on the site is at your own risk.
b) Your access to the website may be occasionally restricted or interrupted to allow for repairs, maintenance or the introduction of new services or because we are unable to offer the site for reasons beyond our control. In this event, we will attempt to restore the service as soon as we reasonably can. Any such restrictions or interruptions shall not constitute a breach by us of these terms.
c) If you are accessing the site from locations outside the UK, you are responsible for compliance with local laws where they are applicable.

8. Intellectual property
a) By providing any content for distribution by us (such as before and after photographs) you expressly grant us a worldwide, royalty-free, perpetual, irrevocable licence to use, copy, store, perform, display and distribute such content.
b) You must not otherwise reproduce, modify, copy, distribute or use for commercial purposes any content from the site without the written permission of Tour Strength LTD.
9. Prohibited use of the site
a) You may not use the website in any way which causes, or may cause, damage to the website or interferes with any other person’s use or enjoyment of the site, or in any way which is harmful, unlawful, illegal, abusive, harassing, threatening or otherwise objectionable or in breach of any applicable laws or regulations.
10. Third party websites
a) The site may contain hyperlinks or references to third party websites other than the site. Any such hyperlinks or references are provided for your convenience only. We have no control over third party websites and accept no legal responsibility for any content, material or information contained in them. The display of any hyperlink and reference to any third party website does not mean that we endorse that third party’s website, products or services. Your use of a third party site may be governed by the terms and conditions of that third party site.
11. Limitation on our liability
a) Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury resulting from negligence) or arising under applicable laws relating to the protection of your personal information, Tour Strength are not legally responsible for any injuries arising from using the information on the site or app. You agree that by performing exercises from the site, app, or other content from Tour Strength, you are doing so at your own risk.
b) The information and videos presented on the Tour Strength website and app are for informational purposes only and are not to be used as medical advice. You should not rely on this information as a substitute for, nor does it replace, professional medical advice, diagnosis or treatment. If you have any concerns or questions about your health, you should always consult with a doctor or other health care provider. Do not disregard, avoid or delay obtaining medical advice from your health care provider because of something outlined in the website or app.
c) You should always consult with your doctor or other health care professional, before becoming more physically active to ensure it is safe to do so. This is particularly true if you (or your family) have a history of high blood pressure or heart disease, or if you yourself have ever experienced chest pain when exercising, or have experienced chest pain in the last two months when not exercising, smoke, have high cholesterol, are obese or have a bone/joint problem that could be made worse by a change in physical activity. Do not start the programme if your doctor or health professional advices against it. Even if you are in good health, there are still risks associated with increasing physical activity levels. You have a responsibility to exercise your own personal judgment, as well as any other considerations, before acting on any of the content provided by us.
d) We will not be liable to you in respect of any losses arising out of events beyond our reasonable control.
e) Any information that we provide, whether obtained through our website, app, social media (such as Facebook, Instagram, Twitter, LinkedIn) or otherwise, is provided for the purposes of general information only.
12. Expected Results
a) While we believe that for most people, following the app programmes and methods will lead to desired results, all exercise programmes depend on the individual. Results will be affected by the effort and commitment of the individual, however in some circumstances even where an individual follows our programme, they may not achieve the desired results. We therefore provide no warranties of any kind, expressed or implied, as to: the effectiveness any techniques or programmes that we deliver; or the results that you may achieve as a result of following the app programmes.
b) All testimonials shown on our website or in our content are real people who have worked with us. For the avoidance of any doubt, however, they are not indicative of the results that you are likely to achieve, rather they are included as examples of the results that particular individuals have achieved.
13. Events beyond our control
a) We shall have no liability to you for any breach of these terms caused by any event or circumstance beyond our reasonable control.
